Cuts in Solar PV Feed-in-Tariff legally flawed

On 21st December 2011 the High Court ruled in favour of the Friends of the Earth and two solar companies that challenged the DECC decision to cut the feed-in-tariff for Solar PV installations 11 days before the consultation on the proposal was due to close.

 

What implications does this ruling have?

The DECC intend to appeal the court ruling. Grounds of appeal need to be filed by the DECC by January 4th. If the Government (DECC) appeal and win there will be a period of ongoing consultation and the feed-in-tariff for Solar PV systems up to 4kW can be expected to remain at 21p per kWh.

 

If the Government (DECC) is unable to appeal or loses on appeal, then the previous tariff of 43p is reverted to until the Parliamentary process has concluded (expected to be 1st April 2012).
